Thank you for considering a gift to Attitude is Everything.

If music and live events play a central part in your life; if live events are what matters most to you; if you believe that live events should be accessible for everyone, a gift in your Will can be used to support us to achieve our aims and make a very real difference to disabled people.

Creating a Will and leaving a legacy can bring up lots of personal questions and so we’ve created this guidance for you that should also be shared with your legal advisors who are preparing your Will.

I would like Attitude is Everything to be a beneficiary in my Will. What do I do?


First of all, you may like to talk to us about your planned legacy. We also strongly recommend that you contact a solicitor to help you write your Will. This can be a relatively inexpensive procedure and by involving a solicitor you ensure that the final document is correctly drafted and will follow your wishes.

If you already have a Will, there is an easy way to change it to add a legacy to Attitude is Everything without preparing a whole new Will. You can instead ask your solicitor about making a Codicil (a simple legal document that amends an existing Will). Your solicitor can explain if this is a suitable option for you and guide you through this process.

What are the options for me to consider?


Examples of the types of legacies that you might like to consider including in your Will are:

Pecuniary legacy

This is a gift of a fixed amount of money decided by you.

Specific legacy

This is a gift of a particular named asset or item, for example a property or stocks and shares.

Residuary legacy

This is a gift of all or a portion of the remainder (also known as the residue) of your estate once your debts, funeral expenses, inheritance tax and so on have been paid and after any pecuniary or specific legacies have been distributed. For example, you could choose to leave Attitude is Everything 10%, 50%, or even the whole of your residuary estate. This type of gift can be particularly useful to you because it avoids you having to decide on a specific sum at the time of writing your Will or needing to make adjustments at a later date if your circumstances change.

Reversionary legacy

This is a gift of an asset (such as a property) that is left for the use of a named beneficiary during their lifetime, after which it would pass to Attitude is Everything.

What is the appropriate wording to use?


When visiting your solicitor to have your Will or Codicil drawn up, you may wish to take the following example legacy wording with you as a guide. Please note that the clauses below are provided as examples only and should not be used without specific legal advice.

Our full name and charity number should be included in any legacy:

Attitude is Everything, a charitable company registered in England and Wales with charity number 1121975 of registered office address 54 Chalton Street, London, NW1 1HS.

Pecuniary/specific legacy wording

“I give [the sum of £X]/[details of a specific item or asset] free of inheritance tax to Attitude is Everything (a charitable company registered in England and Wales with charity number 1121975) of registered office address 54 Chalton Street, London NW1 1HS absolutely for its general charitable purposes. I further direct that the receipt of the person who professes to be the treasurer or other proper officer of the said charity shall be a full and sufficient discharge to my executors.”

Residuary legacy wording

“Subject to the payment of my debts, funeral and testamentary expenses, I give [the whole of/a share (please state fraction/percentage)] of my estate to Attitude is Everything (a charitable company registered in England and Wales with charity number 1121975) of registered office address 54 Chalton Street, London NW1 1HS absolutely for its general charitable purposes. I further direct that the receipt of the person who professes to be their treasurer or other proper officer of the said charity shall be a full and sufficient discharge to my executors.”

Important note

Staff, trustees and volunteers of Attitude is Everything are unable to be directly involved in writing your Will or signing it; neither can we be present at any time during the preparation, drafting and signing of the Will. Any witnesses to a Will under which Attitude is Everything benefits must be independent of the organisation, including staff, trustees and volunteers.

Do I need to consider Inheritance Tax?


Attitude is Everything is a registered charity in England and Wales – this means that legacies left to us are free of inheritance tax and so may reduce the amount of inheritance tax that may otherwise be payable on your estate. If you leave 10% of your net estate to charity, you may benefit from a 10% reduction in the rate of inheritance tax rate payable on your estate, depending on your circumstances. The inheritance tax rules are complex, and so you are strongly recommended to seek independent professional legal and financial advice in relation to your own circumstances.

Can I choose how my gift will be spent?


Yes you can, although we prefer that gifts are not restricted to any one purpose since projects and activities might change over time, or one which might have needed funding when you wrote your Will could be up and running and no longer in need of support by the time we receive the legacy.

We would prefer that your gift was unrestricted, but if you have a preference that your gift should be restricted to a certain purpose, please discuss this with us first so that we can agree with you how to make effective use of your legacy in line with your wishes.

Will my gift be acknowledged in any way?


Unless you chose anonymity, gifts to Attitude is Everything are acknowledged in the most appropriate manner – with a thank you card and letter from our Founder and Board of Trustees, is one such personal way. We will also keep in touch with you and keep you updated about our work, if you wish. We will not contact you without your written consent first.

My main concern is my family. Is it worth leaving Attitude is Everything a gift if it can only be a small amount?


All gifts, large or small, can make a huge difference to our work to improve disabled people’s access to live music and events.
